Legal administration: for who and why? 

Sometimes adults are (no longer) capable of managing their own affairs and/or finances. Is this the case with someone you know and are you wondering if legal administration can be the solution? In this article we will explain who can be helped with this form of administration. 

What is legal administration?

Legal administration is a measure with which people that are not capable of managing their own finances because of physical or mental causes can be protected. By giving someone else the legal responsibility for their financial affairs, you can prevent financial problems from emerging or getting worse. The legal administrator can take responsibility of the material organisation, or a part of it, from those that or under their administration; the rights holder. 

For whom should you apply for legal administration?

Although you can request legal administration for yourself, it is usually someone directly involved that requests for someone else. For example, you can request legal administration for someone suffering from a dementia-related illness, your adult child with down syndrome, a friend with a progressive illness or your sister who is dealing with addiction problems. 

Additionally, a legal administrator can help in a professional setting. As an aid worker or employer you can request administration for, for example, a client that has lost financial overview or an employee whose wages are being seized. 

When someone is not capable of managing their financial affairs responsibly, because of squandering or debts, you can also request legal administration on their behalf. For people that are dealing with issues such as tax debts, excessive spending patterns or more expenses than income, this can contribute to a solution. 

Types of legal administrative management

In addition to the administration described above (for right holders that cannot manage their financial affairs due to physical or mental causes and/or have problematic debts) there are also other types of administrative management. Below we will list all of them:

Receivership, legal administrative management or mentorship?

In addition to administrative management, receivership and mentorship are types of protection for adults that need support when arranging their financial affairs. 

Receivership is one step further than administrative management: Someone under receivership is considered legally incompetent. The curator can decide over both material and non-material affairs. Administrative management is for people who are still considered legally competent. 

Mentorship is usually less invasive than administrative management. A mentor is usually appointed when someone is having difficulty managing their personal affairs. For example, when decisions need to be made about the care and treatment of someone suffering from dementia-related issues, someone who is mentally handicapped, psychiatric or comatose patients, a mentor can have a representative role. Different then with legal administrative management, a mentor has no say about the financial and/or material affairs.  

Why choose legal administration?

In short, you choose for legal administrative management when someone is capable of making decisions for themselves, but is not capable of managing their own financial interests or getting out of problematic debts. For a short or longer period, the legal administrator manages (a share of) someone’s finances and assets. This way financial problems are resolved, risks are limited and worse is prevented.
